These Terms of Service (“Terms”) govern your access to and use of theroadstand.com (the “Site”) and any tools, features, content, and services offered by The Roadstand (“The Roadstand,” “we,” “us,” or “our”), including the Cottage Food Compliance Checker and related tools (the “Tools”).
By accessing or using the Site or Tools, and/or by checking a box or clicking a button indicating your acceptance (e.g., “I Understand,” “I Agree,” or similar), you agree to be bound by these Terms. If you do not agree, do not use the Site or Tools.
1. Eligibility
You must be at least 18 years old to use the Site and Tools. By using the Site, you represent and warrant that you are at least 18 and have the legal capacity to enter into these Terms.
2. Informational Use Only (No Legal or Professional Advice)
The Site and Tools provide general informational content and automated analyses that may reference publicly available materials, including Florida Statute § 500.80 and related guidance.
No Legal Advice. The Site and Tools are provided for informational purposes only and do not constitute legal, financial, regulatory, or professional advice. Use of the Site does not create an attorney-client relationship or any other professional relationship.
No Guarantee. We do not guarantee the accuracy, completeness, reliability, or timeliness of any content or outputs.
AI Limitations. Some Tools use artificial intelligence and automated processes that may produce errors, incomplete results, or “hallucinations,” and may be outdated or incorrectly interpret your inputs.
User Responsibility. You are solely responsible for complying with all applicable laws and regulations. You must independently verify any information, including by consulting the official statute, applicable regulations and guidance, and/or a qualified professional.
3. No Reliance; Assumption of Risk
You agree that you will not rely on the Site or any Tool output for legal, business, compliance, health, safety, labeling, licensing, or financial decisions.
You understand and agree that:
- Tool outputs are not verified and are not definitive determinations of legality or compliance; and
- You assume all risk arising from your use of the Site and Tools, including any decisions you make based on Tool outputs.
4. No Verification; Not a Government Entity; Platform Role
No Verification. The Roadstand does not verify recipes, ingredients, preparation methods, food safety practices, labeling, shelf life, storage methods, or seller operations. We do not conduct inspections or audits and do not guarantee regulatory compliance.
Not a Government Entity. The Roadstand is a private informational platform and is not affiliated with, endorsed by, or acting on behalf of the State of Florida or the Florida Department of Agriculture and Consumer Services (FDACS) or any other government agency.
No Food Sales by The Roadstand. The Roadstand does not manufacture, prepare, package, store, distribute, or sell food products.
5. User Content; Tool Inputs; License
“User Content” means any content you submit to or through the Site, including product descriptions, recipe text, ingredient lists, notes, messages, and other inputs.
You retain ownership of your User Content as between you and The Roadstand.
By submitting User Content, you grant The Roadstand a non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to host, store, reproduce, process, analyze, modify (for formatting and technical purposes), and display your User Content for the purposes of:
- operating, maintaining, and improving the Site and Tools;
- generating Tool outputs you request;
- performing analytics, quality assurance, and performance monitoring; and
- creating aggregated or anonymized insights (for example, “popular items checked”), provided we do not identify you by name in such aggregated/anonymized outputs.
No Sensitive Submissions. Do not submit confidential information or trade secrets unless you are comfortable with it being processed and stored as described above.
6. Privacy
Our collection and use of personal information is described in our Privacy Policy. By using the Site, you agree that we may collect and use information as described in the Privacy Policy.
7. Prohibited Uses
You agree not to:
- use the Site or Tools for any unlawful purpose;
- submit false, misleading, defamatory, obscene, or infringing content;
- interfere with, disrupt, or attempt to gain unauthorized access to the Site, systems, or networks;
- scrape, crawl, harvest, or copy content or outputs at scale without our written permission;
- reverse engineer, attempt to extract source code, or bypass any access controls;
- use the Site or Tools to build a competing product using automated extraction or systematic copying of outputs; or
- introduce malware or otherwise compromise security.
We may suspend or terminate access if we believe you have violated these Terms.
8. Changes, Availability, and Termination
We may modify, suspend, or discontinue the Site or Tools (in whole or in part) at any time without notice. We may also suspend or terminate your access at any time for any reason, including for suspected violations of these Terms.
9. Disclaimers (AS IS / AS AVAILABLE)
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE AND TOOLS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” THE ROADSTAND DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Site or Tools will be uninterrupted, error-free, secure, or free of harmful components.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ROADSTAND (INCLUDING ITS OWNERS, OPERATORS, AND AFFILIATES) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SITE OR TOOLS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ROADSTAND’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE OR TOOLS WILL NOT EXCEED THE GREATER OF (A) $100 OR (B) THE AMOUNTS YOU PAID TO THE ROADSTAND FOR USE OF THE SITE OR TOOLS IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.
Nothing in these Terms excludes liability that cannot be excluded under applicable law.
11. Indemnification
You agree to indemnify, defend, and hold harmless The Roadstand from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to:
- your use of the Site or Tools;
- your User Content;
- your violation of these Terms; or
- your violation of any law, rule, or regulation (including laws related to food production, labeling, licensing, advertising, or sales).
12. Third-Party Links and Resources
The Site may contain links to third-party websites or resources (including government sites). We do not control and are not responsible for third-party content, policies, or practices. Access third-party sites at your own risk.
13. Governing Law; Venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-laws principles.
Any dispute arising out of or relating to these Terms, the Site, or the Tools must be brought exclusively in the state courts located in Pasco County, Florida, or the federal courts for the Middle District of Florida, and you consent to personal jurisdiction and venue in those courts.
14. Miscellaneous
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
No Waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
Entire Agreement. These Terms and the Privacy Policy constitute the entire agreement between you and The Roadstand regarding the Site and Tools and supersede any prior agreements or understandings.
